Terms and conditions of sports Zugerland AG

Scope

These terms and conditions (AGB) govern all contractual relationships between sports Zugerland AG, Riedstrasse 1a, 6330 Cham (hereinafter referred to as "SPOZ") and its customers.

The AGB apply to all services provided by SPOZ, in particular for:

  • the hire of sports facilities (e.g. tennis, squash, badminton, etc.),
  • the provision of courses,
  • restaurant operations and all related services.

By making use of one or more services of SPOZ, the customer accepts these terms and conditions in their respectively current version. Any deviating or supplementary conditions of the customer shall not apply unless expressly agreed otherwise in writing.

Conclusion of contract

A contract with SPOZ is concluded as soon as the customer requests the desired service – in writing, by telephone or verbally – and SPOZ confirms this request – in writing, by telephone or verbally.

For bookings of sports courts, the contract is deemed concluded as soon as SPOZ confirms the reservation or the customer starts using the sports facility.

For course registrations, the contract is concluded upon confirmation of the registration by SPOZ.

For restaurant reservations, the following applies: the contract for the use of restaurant services is concluded upon confirmation of the reservation or acceptance of the order by our service staff.

Payments to SPOZ

Payment method

From June 2026, SPOZ will be cashless. On site in Cham, only debit cards (EC), credit cards (excluding American Express / Amex) and TWINT are accepted as means of payment. Invoices sent by post or e-mail must be settled by bank transfer and cannot be paid on site by card or TWINT.

Late payment

In the event of late payment, SPOZ reserves the right to charge reminder fees plus default interest and, if necessary, to initiate legal action.

Payment terms

In principle, payments for the use of SPOZ offerings (excluding restaurant operations) must be made in advance (before the offering is used).

Payments against invoice are in principle payable within 30 days, but always before the service is rendered, without deductions.

Exceptions are services for which the exact use of the offerings is not known in advance (variable services, for example for events). For such variable services, however, a fee (for example a reservation fee) may be charged in advance. These fees are payable within 30 days of invoicing, but always before the service is rendered.

Payments for services already rendered are due within 10 days of delivery of a summary of the services consumed (usually in the form of an invoice).

Court hire

Booking

A booking for sports courts can be made online, by telephone or on site. Once made, the reservation is binding and obliges payment of the corresponding court fee.

Bookings via the online reservation system can be made at most 3 weeks in advance.

Rescheduling

Any changes to existing bookings must be made independently by the customer in the online reservation system.

Cancellation

Cancellation is possible up to 8 hours before the planned booking time (e.g. by e-mail or telephone). If the cancellation occurs later than 8 hours before the appointment, the customer is obliged to pay the full booking amount.

Cancellations by SPOZ

SPOZ reserves the right to postpone or cancel bookings for important reasons (e.g. maintenance work, the holding of events). In the event of a cancellation, the customer will be informed immediately and will receive either a replacement offer or a full refund of payments already made.

Courses

Registration

Registration for courses can be done online, by telephone or on site. The registration is binding and the customer undertakes to pay the course fee.

Cancellation

Cancellation of a course registration is not possible. Rebooking to a different course is also not possible. The course is invoiced immediately after registration. The full course fee is payable regardless of partial non-attendance.

Cancellations by SPOZ

SPOZ reserves the right to postpone or cancel courses for important reasons (e.g. illness of the course instructor or an insufficient number of participants). In the event of a cancellation, the customer will be informed immediately and will receive either a replacement offer or a full refund of the course fees.

Memberships

Purchase

A membership can be purchased by telephone or on site. For memberships with a long-term booking option, there is a right of first refusal (Vorkaufsrecht) for the following membership period. This right of first refusal lapses if payment for the membership is not received by SPOZ at least 45 days before the start of the membership (payment in SPOZ's possession).

Booking quota (Buchungskontingent)

Memberships each have a booking quota. This is fixed for each membership and cannot be increased or reduced. Booking quotas cannot be transferred to other memberships.

Booking

Bookings under memberships must be made and managed independently by the customer via the online reservation system.

If a membership includes a long-term booking option (for bookings more than 3 weeks in the future), this long-term booking option is initially entered by SPOZ in the online reservation system. Any subsequent changes must, however, again be made independently by the customer in the online reservation system.

Customers can only manage bookings up to a maximum of 3 weeks in advance.

Membership bookings are only possible within the membership period in the online reservation system. If the booking quota is not fully used, the quota lapses and cannot be transferred to another membership.

Rescheduling

Any changes to existing bookings must be made independently by the customer in the online reservation system.

Bookings that are cancelled or rescheduled in the online reservation system at least 8 hours before the respective booked unit are not deducted from the booking quota. Bookings that are cancelled in the online reservation system less than 8 hours before the respective booked unit are deducted from the booking quota.

Cancellation

No refund is given upon cancellation of memberships. Upon cancellation of a membership, the respective booking quota is forfeited.

Changes or cancellations of bookings by SPOZ

SPOZ reserves the right to postpone or cancel bookings for important reasons (e.g. maintenance work, the holding of events). In the event of a cancellation, the customer will be informed immediately and the cancelled booking will be credited back to the membership's booking quota. Under no circumstances will a refund be given.

  • Bringing food onto the playing surfaces, and eating there, is not permitted.
  • Dogs and other animals are not permitted anywhere within the sports area.
  • Drinks may only be brought in using resealable bottles.
  • Waste must be disposed of only in the waste bins provided for that purpose.
  • Chewing gum must be disposed of properly in the waste bins; spitting it out or leaving it on the facilities or the floor is prohibited.
  • The use of old, damaged or crumbling grip tape (Griffbänder) is not permitted.

In the event of non-compliance with these court and usage rules, we expressly reserve the right to charge the user a cleaning and/or repair fee of CHF 250.–. Further claims for damages remain reserved.

Conduct rules

  • Customers must behave respectfully, politely and considerately towards staff, other guests and third parties.
  • Insulting, discriminatory, harassing, threatening or aggressive behaviour will not be tolerated.
  • Staff instructions must be followed.

In the event of violations of these conduct rules, we reserve the right to remove the persons concerned from the premises and to issue a temporary or permanent ban from the premises (Hausverbot). Services already rendered will not be refunded in this case. Further legal action remains reserved.

Property damage, soiling and video surveillance

Careful use

Users of the sports facility are obliged to treat all fittings, equipment and premises carefully and to leave them clean.

Compensation for damage

In the event of wilful or negligent damage (vandalism), the operator will invoice the person responsible in full for the actual repair or replacement costs.

Flat cleaning fee

In the event of excessive soiling (e.g. from leaving litter behind, vandalism or disregard of the usage rules) that requires special cleaning, a flat administrative and cleaning fee of CHF 250.– will be invoiced to the person responsible. The user reserves the right to provide evidence that no costs, or substantially lower costs, were incurred. A demonstrably higher cleaning effort will be billed at actual cost.

Video surveillance

To uphold the operator's right of house authority (Hausrecht) and to clarify property damage, thefts and serious soiling, designated areas of the sports facility are under video surveillance.

Data storage and review

Recordings are automatically overwritten after 48 hours at the latest. If there is concrete suspicion of a damage or soiling incident, the operator is entitled to evaluate the footage in order to identify the person responsible and to secure it as evidence. Further details are governed by the separate privacy policy.

Data protection

Collection and processing

SPOZ collects, processes and uses the customer's personal data exclusively for the performance of the contractual relationship and within the scope of statutory provisions, in particular in accordance with the Swiss Data Protection Act and, where applicable, the EU General Data Protection Regulation.

Customer's rights

The customer has the right at any time to information about the data stored about them, as well as to rectification, restriction or deletion, insofar as no statutory retention obligations conflict with this.

Amendment of these terms and conditions

SPOZ reserves the right to amend these terms and conditions at any time. Changes will be communicated to the customer in a suitable manner.

Continued use of SPOZ's services after the changes have been announced constitutes acceptance of those changes.

Final provisions

Swiss law applies exclusively to all legal relationships between SPOZ and the customer, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (UN-Kaufrecht).

The place of jurisdiction (Gerichtsstand) for all disputes arising from or in connection with the contractual relationship is – to the extent permitted by law – the registered office of SPOZ in Cham.

Should individual provisions of these terms and conditions be or become invalid or unenforceable, in whole or in part, whether at the time of conclusion of the contract or subsequently, the validity of the remaining provisions shall remain unaffected.
